Declaration to entrust work to a foreigner (oświadczenie)

The declaration to entrust work to a foreigner (oświadczenie o powierzeniu wykonywania pracy cudzoziemcowi) is a simplified path for legalising the employment of citizens of selected non-EU countries. It lets you hire without going through the full work permit procedure, cutting the waiting time to a few business days and reducing administrative cost.

Who can use this track

The declaration applies to citizens of five countries: Armenia, Belarus, Georgia, Moldova and Ukraine. The total maximum work period under declarations is 24 months. The employer files the declaration with the local labour office (PUP — powiatowy urząd pracy), which, after verification, enters it into the register.

Important — for Ukrainian citizens a separate special regime under the 2022 Act on Assistance to Citizens of Ukraine (UKR22) runs in parallel. In that case employment is notified through praca.gov.pl within 14 days of starting work, rather than via a declaration. The act is periodically extended; check the current status at gov.pl.

Documents for the PUP

  • Declaration form with employer and foreigner data
  • Copy of the foreigner's travel document
  • Employer's statement of no criminal record
  • Proof of payment (PLN 100 per declaration)
  • Draft employment terms — pay not lower than comparable employees
